Ooma’s “Gift of Ooma” Official Rules

IF YOU DO NOT AGREE TO THESE OFFICIAL RULES, DO NOT ENTER THE SWEEPSTAKES.

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

Eligibility:The sweepstakes is open to legal residents of the 50 United States including the District of Columbia who are 18 years of age or older at time of entry. Employees of Ooma, Inc. (“Sponsor”) and their immediate family members (parents, siblings, children and spouse, and any person residing in the same household whether related or not), its affiliated companies and subsidiaries, and their advertising and promotion agencies associated with Ooma’s Summer Sweepstakes ( “Sweepstakes”), and their respective agents, officers, and directors, and all individuals, including, but not limited to, consultants, independent contractors, temporary or contract employees, former employees and interns, and their immediate family members who within the past six months have performed services for Sponsor are not eligible to enter or win.
Sweepstakes Period: The Sweepstakes begins at 9:00 a.m. PST on Thursday, Dec 8, 2022, and ends at 8:30 p.m. PST on Saturday, December 31, 2022 (the “Sweepstakes Period”). Sponsor or its duly authorized representative shall determine all Sweepstakes-related time periods.
How to Enter: During the Sweepstakes Period, you can enter for free by visiting Sponsor’s Facebook page at https://www.facebook.com/oomainc, locating the “Gift of Ooma” promotional post, and leaving a gift emoji in the comments. Receipt of entry will not be acknowledged. Alternatively, you can enter by mailing a written request to Sponsor at the address below. Any mailed entries must be received by Sponsor before the end of the Sweepstakes Period.
Limit: Limit of one (1) entry per person.
How to Win: One winner (“Winner”) will be determined via a random drawing for the Prize (as defined in Section 6 below) on or about Tuesday, January 3, 2022. The potential winning entrant will be notified by a Facebook comment posted approximately forty-eight (48) hours following the drawing. Sponsor will reply to entrant’s comment made on the Summer Sweepstakes promotional post and not directly to the entrant. Upon receiving notification, the potential winning entrant must successfully reply to Sponsor or its representative within forty-eight (48) hours following notification to be selected as the Winner, or Sponsor may award the prize to the next eligible potential winning entrant. In the event Sponsor or its designee is unable to successfully communicate with a potential winning entrant, Sponsor may award the prize to the next eligible entrant(s) until such time a winner is determined. No more than three potentially winning entrants will be contacted, after which the prize will remain un-awarded.
Prize: One winner will receive a prize of an Ooma Telo Air for home phone service (approximate retail value or “ARV:” $129.99) and a retro home phone (retail prices vary from $44.95 to $49.95) (the “Prize”). Total ARV of Prize: $174.94 to $179.94.
Taxes: ALL FEDERAL, STATE, AND LOCAL TAXES, INCLUDING INCOME TAX, ARE SOLELY THE RESPONSIBILITY OF THE WINNER. Any difference between the stated estimated value of the prize and its actual value will not be awarded. Winner agrees to accept the prize “as is.”
Odds of Winning: The odds of winning will depend on the number of eligible entries during the Sweepstakes Period.
Prize Restrictions: The Prize is nonrefundable and nontransferable. Sponsor is not required, but has discretion to offer substitutions, a cash redemption or alternative to the Prize awarded under this Sweepstakes. Sponsor reserves the right to substitute a prize of equal or greater value if the Prize is unavailable.
General Entry Rules: Any entrant who attempts or otherwise encourages others to manipulate or create multiple entries or acts in violation of these official rules will be disqualified. Any attempt by any person to tamper with the Sponsor’s Facebook page or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and/or civil law. Should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies to the fullest extent permitted by law. Sponsor reserves the right to take any and all measures it deems necessary to ensure a fair Sweepstakes. Incomplete entries are ineligible, disqualified and void. Sponsor is not responsible for circumstances that may limit or otherwise restrict the ability to participate including, but not limited to: (i) late or incomplete entries; (ii) errors that occur in entrant winner notification or other Sweepstakes-related communications; (iii) or for any posting errors in these official rules.
Limitation of Liability: By entering this Sweepstakes, entrants waive all right to, and hold Sponsor and Facebook harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in this Sweepstakes or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Sponsor and Facebook will not be responsible for: late, incomplete, or incorrect entries; an entrant’s failure to receive prize notices due to entrant’s spam, junk e-mail, or other security settings or for entrants’ provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Sweepstakes; by any human error which may occur in the processing of the entries in this Sweepstakes; or any typographical, technological, or other error in the publishing of the Sweepstakes, administration of the Sweepstakes, or announcement of the prize. Sponsor reserves the right to, in its sole discretion, cancel or modify this Sweepstakes in a manner deemed appropriate by Sponsor. In the event of termination, Sponsor may still select a potentially winning entrant from among all eligible entries received as of date of termination. If for any reason the Sweepstakes cannot be conducted as described in these official rules, including but not limited to due to an error, or if there is any suspected evidence of tampering with any portion of the Sweepstakes, or if technical difficulties (including viruses and bugs) compromise the integrity of the Sweepstakes, Sponsor shall have the right, at its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes and select a potentially winning entrant from entries received or as otherwise deemed fair and appropriate by Sponsor.
Release: By entering, entrants and the Winner agree to be bound by these official rules and agree that Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, successors, and assigns, may use (unless prohibited by law) Winner’s Facebook post, name, likeness, image, photograph, voice, city/state of residence, biographical information and the prize for advertising, trade and promotion in any media or format, including social media without further compensation, permission or notification, except where prohibited by law. Winner may be required to sign and return to Sponsor an Affidavit of Eligibility and Publicity/Liability Release or the prize may be forfeited and awarded to an alternate.
CA Section 1542: Entrants expressly waives the provisions of Section 1542 of the California Civil Code and any other statutes, rules, laws, ordinances, or common law principles or other authority of any jurisdiction, and further waives any right to invoke said provisions now or in the future with regard to the Sweepstakes. Entrants and Winner further acknowledge and agree that this waiver is an essential and material term of these official rules and the Sweepstakes.
Governing Law: Except to the extent pre-empted by federal or other applicable state law, the Sweepstakes shall be governed by the laws of the State of California, without giving effect to any conflict of law provisions thereof. Entrants understand and agree that all claims, disputes or controversies between entrant and the Sweepstakes Entities shall be resolved by final and binding arbitration in the County of Santa Clara, State of California. By entering, entrants voluntarily and knowingly waive any right they have to a jury trial.
Winner List and Official Rules: Individuals may request a copy of the official rules and/or name of the Winner by sending a self-addressed, stamped envelope by January 31, 2023 to: Ooma, Inc., 525 Almanor Avenue, Suite 200, Sunnyvale, CA 94085, Attn: Ooma’s Gift of Ooma Sweepstakes.
Privacy Policy: Personal information provided by Entrants to enter the Sweepstakes is subject to Sponsor’s Privacy Policy which can be found at https://www.ooma.com/legal/privacy-policy/.
No Waiver: Failure by the Sponsor to enforce any provision of the official rules shall not constitute a waiver of that provision.
Sponsor: The Sponsor of the sweepstakes is Ooma, Inc., headquartered at 525 Almanor Avenue, Suite 200, Sunnyvale, CA 94085. The Sweepstakes is in no way sponsored, endorsed, administered by or associated with Facebook.
